1. What this agreement covers

These Terms govern your use of StormRoute's storm-brief service (the "Service"). By signing an Order Form referencing these Terms, accepting them at online checkout, or using the Service, you agree to them. If you join online, your checkout confirmation (plan, price, and the date you accepted these Terms) is your Order Form. If you're accepting for a company, you confirm you're authorized to bind that company.

This is a business-to-business service. It is not offered to consumers for personal use.

2. What the Service actually is

StormRoute delivers a daily storm-canvassing brief: ranked lists of the streets under qualifying radar hail or near qualifying wind reports, shown in the StormRoute app and sent by email. Each morning we retrieve publicly available severe-weather data — NOAA radar hail estimates and National Weather Service / Storm Prediction Center (SPC) reports — compare them against the service areas you configure, and send you a summary of qualifying hail and wind reports — including affected areas, reported magnitudes, and suggested canvassing locations.

What the Service is not — stated plainly because it defines everything below:

2.1 How briefs are produced — automated generation

Briefs are produced by an automated system. After each storm, our software retrieves NOAA radar hail estimates and National Weather Service reports, crosses them with mapped house footprints inside your service area, and ranks the streets. Where a brief includes written text (for example a short summary), that text may be drafted by an artificial-intelligence system. Briefs are not reviewed by a person before they are sent to you.

Automated systems of this kind can make errors that differ from data errors: they can misstate a location, magnitude, date, or street; omit a qualifying report; or produce confident-sounding text that is wrong. The Service applies automated checks (a data receipt confirming the underlying reports were retrieved, and a "could not verify" notice when they were not), but these checks reduce error; they do not eliminate it.

You are the human review step. See §4.

3. The data, and its limits

Our briefs are built from third-party government data we do not control, produce, or verify. NOAA SPC reports are preliminary, unverified public reports — commonly submitted by storm spotters, law enforcement, and the public. They are frequently incomplete, delayed, mis-located, or later revised or withdrawn by NOAA. Radar hail estimates (NOAA MRMS) are model estimates of hail aloft at about 1 km resolution; hail reaching the ground can be smaller or larger than the estimate, and small cells can be missed or misplaced.

You acknowledge: the absence of a report does not mean no storm occurred, and the presence of a report does not mean damage occurred. Weather data is inherently uncertain. Every operational decision you make — where to send crews, whom to contact, what to spend — is yours alone.

4. Your responsibilities

You agree to: - Independently verify conditions before dispatching crews or making representations to any property owner. - Comply with all laws governing your outreach, including door-to-door solicitation rules, local permits, the Telephone Consumer Protection Act, CAN-SPAM, and all Texas insurance laws — specifically including Tex. Ins. Code § 4102.163 (a roofing contractor may not act as a public insurance adjuster, or advertise to adjust claims, for any property for which the contractor is providing or may provide roofing services) and Texas House Bill 2102, effective September 1, 2019 (a contractor may not pay, waive, rebate, credit, absorb or offset an insurance deductible, or advertise that it will; a violation is a criminal offense for both the contractor and the policyholder, and contracts over $1,000 for insurance-claim repair must carry the required bold-faced deductible notice). See §4.1. - Review all generated content before you use it. Any door-approach script, advertisement, message, or other copy contained in a brief is a draft for your review, not approved marketing. You are solely responsible for reviewing, correcting, and approving it before it is spoken to, shown to, or sent to any property owner or the public, and for ensuring it complies with all laws governing your outreach, including the Texas insurance laws identified above. You must not forward a StormRoute brief, or any copy generated within it, to a property owner. Briefs are internal operational tools. - Make no claim, promise, or representation to any property owner that StormRoute has inspected, verified, or confirmed damage to their property. - Keep your account credentials secure and your service-area configuration accurate. - Use the Service only for your own business, and not resell, sublicense, or redistribute our briefs. You may share briefs internally across your own locations and employees. You may not resell, sublicense, or redistribute them outside your company.

4.1 Prohibited representations (Texas insurance law)

Because generated copy is a draft you adopt as your own, you agree that you will not use any brief content — as written or edited — that states or implies any of the following:

Never say Why
"Free roof," "no out-of-pocket," "$0 down and insurance covers the rest" Reads as an implied deductible waiver — HB 2102
"We'll cover / waive / eat / help with your deductible" Direct HB 2102 violation
"We'll handle your claim," "we'll file it for you," "we'll negotiate with your adjuster," "we'll get your claim approved," "we know what the carrier owes you" Describes public adjusting — Ins. Code § 4102.163
"StormRoute confirmed / verified damage to your home" False, and contradicts §2

What is accurate and permitted: a storm was reported in the area; we offer a free inspection; if we find damage we will show you what we found and what it costs; you file with your carrier and we can meet your adjuster on site as your contractor.

5. Subscription, billing, and cancellation

Plan Price Setup Year-one total
Month-to-month $750/month $1,500 once — charged again if you cancel and later restart $10,500

Setup covers territory build, threshold configuration, delivery verification and onboarding. Every price is disclosed in full before you are charged. Online payments are processed by Stripe; invoices by Wave. We never see or store your card number.

6. Service availability

We aim to deliver each brief the morning after a qualifying storm, but do not guarantee delivery, timeliness, or uninterrupted availability. Delivery depends on NOAA data availability, email providers, and other systems outside our control. A missed or delayed brief is not a breach of this agreement. If we cannot verify fresh data, we will tell you so rather than guess — and a "could not verify" notice is a valid delivery under these Terms.

7. Confidentiality of your configuration

Your service areas, thresholds, and briefs are confidential to you. We will not disclose one customer's configuration or briefs to another customer.

Your configuration data and briefs are processed by the third-party providers listed in our Privacy Policy, including Anthropic (Claude) for brief generation. We do not sell your data.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, STORMROUTE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE DATA IS ACCURATE, COMPLETE, CURRENT, OR RELIABLE; THAT ANY STORM REPORT REFLECTS ACTUAL PROPERTY DAMAGE; OR THAT USE OF THE SERVICE WILL PRODUCE ANY BUSINESS RESULT, LEAD, APPOINTMENT, SALE, OR RETURN ON INVESTMENT.

WE DO NOT WARRANT THAT ANY AUTOMATED OR AI-GENERATED OUTPUT — INCLUDING BRIEF TEXT, LOCATION GROUPINGS, SUGGESTED CANVASSING AREAS, OR DRAFT OUTREACH OR ADVERTISING COPY — IS ACCURATE, COMPLETE, LAWFUL FOR YOUR INTENDED USE, OR FREE FROM ERROR, INCLUDING ERRORS PRODUCED BY THE GENERATION PROCESS ITSELF RATHER THAN BY THE UNDERLYING DATA. ALL GENERATED CONTENT IS PROVIDED AS A DRAFT FOR YOUR REVIEW.

NO ADVICE OR INFORMATION FROM STORMROUTE CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, STORMROUTE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

STORMROUTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITY, WASTED LABOR OR CANVASSING COST, OR REPUTATIONAL HARM, EVEN IF ADVISED OF THE POSSIBILITY.

THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND ARE A FUNDAMENTAL BASIS OF THE BARGAIN; THE PRICE OF THE SERVICE REFLECTS THIS ALLOCATION OF RISK. FOR THE AVOIDANCE OF DOUBT, THESE LIMITS APPLY EQUALLY TO CLAIMS ARISING FROM AI-GENERATED OR OTHERWISE AUTOMATED OUTPUT, INCLUDING BRIEF TEXT AND DRAFT OUTREACH OR ADVERTISING COPY, WHETHER THE CLAIM IS FRAMED AS SERVICE FAILURE, DEFECTIVE OUTPUT, MISREPRESENTATION, OR OTHERWISE.

Nothing here limits liability for gross negligence, fraud, or intentional misconduct — Texas law does not permit that, and we do not attempt it.

10. Indemnification

You'll defend and indemnify StormRoute against third-party claims arising from your use of the briefs — including your canvassing, your representations to property owners, your insurance-related statements, your use of generated content, and your violation of law or these Terms.

This indemnity runs one way, and here is why. You perform every act that can reach a third party: you decide where to go, you speak to the property owner, you make the insurance-related statements, and you adopt and use the generated copy. We send you an email. The party who controls the outward-facing conduct carries that conduct's risk.

11. Intellectual property

We own the Service, our software, and the format and copy of our briefs. You own your configuration data. You get a non-exclusive, non-transferable licence to use the briefs in your own business for the subscription term.

12. Term, suspension, termination

Either party may terminate at the end of any billing period. We may suspend or terminate immediately for non-payment (per §5), unlawful use, or any use that risks harm to property owners or to us.

The following are material breaches permitting immediate termination without refund: (a) forwarding, showing, or sending a brief — or any copy generated within it — to a property owner, in violation of §4; (b) using any of the representations prohibited by §4.1; (c) reselling, sublicensing, or redistributing briefs outside your company.

Sections 3, 8, 9, 10, 11 and 14 survive termination.

13. Changes to these Terms

We may update these Terms with 30 days' email notice. Continued use after that is acceptance. Material changes to §8 or §9 require your affirmative acceptance — we will email you the change and ask you to reply agreeing to it, and the change does not apply to you until you do.

14. Governing law and disputes

Governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Venue lies exclusively in the state or federal courts of Travis County, Texas, and each party consents to that jurisdiction.

15. Entire agreement

These Terms plus your Order Form are the entire agreement and supersede all prior discussions, proposals, and marketing statements. If any provision is unenforceable, the rest remains in effect.
